Terms of Service

Welcome to Fathom Blue. These Terms of Service ("Terms") govern your use of the Fathom Blue mobile application and website (www.fathomblueco.com) operated by Fathom Blue ("we", "us", or "our"). By downloading the app or using our website, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Fathom Blue, you confirm that you:

  • Are at least 18 years of age, or have verifiable parental or guardian consent if you are between 13 and 17 years of age.
  • Have read, understood, and agree to be bound by these Terms.
  • Agree to our Privacy Policy.
  • Accept full personal responsibility for your breath-hold training activities.

2. Description of Service

Fathom Blue is a breath training application designed to help freedivers, spearfishers, and surfers improve their breath-hold capacity through structured CO₂ and O₂ training tables. The app provides training timers, progress tracking, educational content, and technique guides.

The app is available on iOS (App Store) and Android (Google Play). A limited free tier and a premium subscription tier are available as described in Section 4.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@fathomblueco.com if you suspect any unauthorised use of your account.

4. Subscription Terms

Free Tier

The free tier includes up to 3 training sessions per week, basic CO₂ and O₂ tables, progress tracking, and is supported by advertising. No payment is required.

Premium Subscription

  • Monthly: $12.99 / month
  • Annual: $69.99 / year

Premium includes unlimited training sessions, advanced table types, the spearfishing technique library, wearable device integration, no ads, and priority support.

Billing and Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your payment method will be charged via the Apple App Store or Google Play at the applicable rate.

Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain access to premium features until then. We do not provide refunds for partial subscription periods.

Price Changes

We reserve the right to change subscription prices. We will notify you at least 30 days before any price increase takes effect. Your continued use of the premium tier after the effective date constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or modify the app.
  • Scrape, harvest, or collect data from the app without our written consent.
  • Use the app in any way that could damage, disable, or impair our servers or networks.
  • Share your account credentials with others or resell access to the service.

6. Intellectual Property

All content within Fathom Blue — including training programs, text, graphics, the Fathom Blue name, logo, and training methodologies — is owned by Fathom Blue and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Disclaimer of Warranties

Fathom Blue is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of viruses.

Training information provided in the app is for educational purposes only and does not constitute medical or professional freediving instruction. Always consult a qualified freediving instructor and, where appropriate, a physician before beginning any breath-hold training program.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Fathom Blue and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to personal injury, loss of data, or loss of profits — arising out of or in connection with your use of the app or your breath-hold training activities.

Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Age Requirements

Fathom Blue is intended for users aged 18 and over. Users aged 13–17 may use the app only with verifiable parental or guardian consent. We do not knowingly permit users under 13 to create accounts.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in the relevant jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Your continued use of the app after the effective date constitutes acceptance of the updated Terms.

12. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may terminate your account at any time by contacting us or deleting the app. Termination does not entitle you to a refund of any subscription fees paid.
